The 6th February '12 Supreme Court order

Good Morning Speakasians,

Congratulations all Speakasians this is our first step to absolute victory. The hon’ble Supreme Court has passed an order which is absolutely in our favor....
The salient features of today’s orders are as follows:

1. SAOL has been ordered to deposit 50 crores with the Supreme Court Registry.

2. CBDT (IT Dept) has been asked to give the details of their dues.

3. EOW has been ordered to handover the admin rights of the website along with all other material to the Hon’ble Mr. Justice Lahotiji.

In this order the apex court has ordered the Reserve Bank of India to file an affidavit within a period of two weeks. And now the hearing is listed on 6th Feb, 2012. We would like to draw your attention to an E mail communication dated 14th December, 2011, in which RBI has written to the company saying that the RBI has not placed any restrictions on the company bringing in money through proper banking channels, Further RBI has not placed any restrictions to pay any money to the panelists in accordance to law.

With this clarification from the RBI the way is cleared for the company to bring in the money for the panelists and is now only dependent on getting the requisite clearance from the Supreme Court. From this email communication we can be confident that the RBI's report to SC will definitely be positive.

And once the RBI files an affidavit in the SC and gives an order based upon it, then the way will be clear for SAOL to distribute the money to the panelist and probably restart the business once again in full fledged manner.

Lets stay united in this last lap of victory.

Updates as on 9th Jan.'12

Following are the latest updates on Speak Asia:

1. Today all the concerned parties to the case like RBI, EOW, CBDT, SAOL and others were been represented by their lawyers in court room. This was the major happening in the court room today where each and every party was present.

2. These Parties said to the court that they are unaware of the content of the mediation report submitted by Honorable Justice R. C. Lahoti to the Supreme Court, hence its difficult for them to give any decisions as they have not read the report yet.

3. Honorable Judges of Supreme Court has given orders to provide mediation report to all the Parties as soon as possible.

4. Now next hearing is fixed on Next Monday i.e. 16th Jan, 2012.

5. In the meanwhile the speakasiaonline.com website is back and operational once again. But as per the officials of SAOL the site is still with the EOW and has not been given back to Speak Asia management. The RPs which has got credited on 5th January, 2012 in your respective E-Vallets is the result of an automated process in the website and any operation has not been performed on the website from the SAOL technical team yet.

Friends ! the time to celebrate has not come yet. So there is nothing to get very excited. We need to wait for next Supreme Court hearing on 16th January, 2012. But from our continuous interactions with various authentic resources, Lawyers and SAOL officials one fact we can assure you all that our victory is not too far and we are surely going to see the business of Speak Asia getting normalized very soon. At this last phase of battle lets not get panic and wait for the next Supreme Court hearing.

In Solomon jame's case,Today Report has been submitted by Shri Lahoti ji In Supreme court and sent to Registry. 

The Hearing (Probably Judgement) will be Announced On 9th Jan 2012.

The heart wants to start celebrating but the mind advices to show some restraint till the final 


verdict is announced by the Hon. Supreme Court .

Hon’ble Mr. Justice R.C. Lahoti ji has concluded his mediation process yesterday i.e. 19 


December, 2011 .

It is now clear that all the respondents have recorded their presence before the Hon. Mediator 


including the elusive EOW .

Hon’ble Mr. Justice Lahoti ji will soon file his report before the Hon. Supreme Court and the 


matter should come up for hearing before the Supreme Court in early January, 2012 .

I only wish to draw the attention of all the Speakasians that although the matter is moving 


positively in our favour the relief as is being spread on various forums is absolutely false and 


baseless .

The WEBSITE AND PAYMENTS are not going to start before 28 December, 2011 etc. like is 


being reported on various forums. All this will surely happen but only after the matter has been 


and finally ordered by the Hon. Supreme Court.

It is now only a matter of time that we all will taste sweet victory very very soon .

Dear Speakasians...


Greetings to all....i know as everyone is upset and depressed bcoz people had many expectations on today's meeting which was held...the meeting was held in a positive way...and again notices or reminder has been sent to the concerned authority EOW which did not turned up even today.

The extension of Melwyn Crasto Sir and Postponing of Raigarh and thane case was again a little depressing...Let me tell you all clearly unless and until the payment wont start these all external issues will keep on happenning to create panic amongst all speakasian...All i can say is we need to wait for another few 10-15 days for things to happen which everyone will be happy to know...
... 
The only thing which is delaying our matter as of now is the absence of EOW to give authorization for our server to access...Unless and until EOW will not turn up it would be difficult for us to get the server and start the payment process which may delay...But if Justice Lahoti wants it to be done before Christmas then i will be greatful to him and blessings of all of us will be there...

The fight is still on and we are very near for our business to get things normalized as soon as possible...but because of the enemity and business rivalries we are facing the problem till now and the delay done by Govt. agencies.

All i want to say is please hold on your breathe for few days and be patience and control ur downline or team for few more days and i am sure things to be done in a positive way which will not only bring peace to all panelist but will also be good for a long run for a great journey ahead...

Dear Speak Asians,

The past few weeks have been very eventful. While we are very happy that the first hearing of the committee appointed by the honorable Supreme Court for mediating amongst various parties concerned under the capable stewardship of the former Chief Justice of India, Justice R.C Lahoti, met towards the end of November and started the process of mediation in the right earnest.

However ever since this hearing, the entire Speak Asians community inclusive of the company and its employees, panelist and their family members including both women and old parents have become the target of  a renewed malicious campaign by the authorities. This started with the arrest of Mr. Melvin Crasto, President of the AISPA and also this followed up with the arrest of one of the Regional Manager of our company.  Both these actions are highly deplorable as they come in the back drop of the mediation process already set in motion. We are given to believe though reliable sources that a senior officer of EOW has gone on to state that there will be more such arrests in the very near future with an aim of spreading panic amongst the panelist community which till now has been the major source of strength for the company.

We would like to assure all our stake holders that we will leave no stone unturned, not only to resolve the current situation but also to restart our business at the earliest. All our endeavors are aimed towards ensuring that our entire community including our employees, panelist and business associates is in no way inconvenienced any further.

First of all, I want to remind you, SAOL’S 17 OCTOBER COMMUNICATION in which company clearly mentioned that they are ready to pay all panellists.

Also in my previous updates I had already mentioned that we are going to have some cheers very soon, so we got a date of 21 November.

Today SC was very unhappy as again no Govt Agencies turned up. We should celebrate it because after having a long investigation process , they are still unable to file even a cut of paper against our company.

Honorable retired justice Mr R C Lohati Sir got all right to be a mediator between Govt Agency and company to resolve the issue.

On 21 November, he may give instruction to all concern parties to case to finalize our most awaited payouts to all the panelists.

The following major happenings are going to happen in next 7 days which are---

1. Hearing before Mumbai high court on 16 th November Along with PIL OF AISPA: I want to remind you again it is our original case which will decide future of business restart.

2. As you know that after this case, our website is taken by EOW IN THEIR control, so after 16 November, company will initiate process of tacking back server, Any day after 16 you may be able to login again.

3. You may be become surprised to know that after 21 November, Any day u can hear the news of payouts.

4. Company’s top officials are holding communication with each other to formulate all steps forward.
