Good Evening Speakasians,

Under advice of our legal counsel i have been advised not to discuss the matter of Mr. Tarak Bajpai’s release.

I would like to assure you, that Tarak Sahib and SAOL are being represented by TOP legal luminaries who will ensure a rightful culmination of this entire matter. You have to realize that this a public forum and we cannot discuss strategy here.

Today your Association first met some high ranking journalists who were willing to lend us a friendly ear and advice us on how to tackle the negativity of the press towards SAOL.
Mr. John Varghese, Panelist, helped us with his contacts in the media. They have advised us on how to go about the entire process to find some positive space in the media. Your Association will soon be taking these steps and I will inform you all as they unfold.

The next part of the day was spent with the Sub Committee (Media) consisting of Mr. Aman Azad (responsible for all the videos that you see on the site) Mr. Vikalp Shrivastava (who came down from Pune in very heavy rains, along with the Web Designer) Mr. Devesh Shah, Kohei, and Mr. and Mrs. Roshini Arora, who is a software professional herself. (Roshiniji very graciously helped my wife serve tea and snacks in our long meeting of five hours)

Mr. Melwyn Crasto, our President presided over both the meetings, tirelessly with his calmness and wisdom. After all he is a certified Sensei

In consultation with the committee office bearers we have now handed over the project of
“WEB Designing with WEB application development & hosting solutions”
to M/s KarnaniSOFT of Pune.

Very Soon our website will be up and it will be an authenticated virtual space where you will receive the latest updates on SAOL and where you can post your questions and resolve your problems.

Once our company rises above the problems that we are facing, this website will act as a direct interface between the company and the panelists.
Speakasians please remember that we do not have any complaint against our company SAOL which have always given timely payments and through various forums interacted with us directly to create this moral strength—‘which is the speakasia family’.
If the EOW had any substantial case against SAOL the courts would have extended police custody to Tarak Sahib and other officials.
The very fact that the Hon. Magistrate at the Esplanade Court (Quila court) granted unconditional bail and later the Hon. Magistrate at the Thane Court granted unconditional bail on surety of a meager Rs. 25000/- without giving further police custody stands testament to the fact that EOW has not been able to convince these courts of a prima facie case against SAOL.
I have heard that some panelists across India are in the process of filing FIRs, in favour of the company, against the ORIGINAL COMPLAINANTS of the company, on the following grounds:


Malicious intent.
Conspiracy against the company.
Human Right violation.

I urge all such panelists who are taking this counter attack position please do not open up such fronts.
We are ethical associates of an ethical international company we do not believe in such negative combat.
Speakasians! We are not afraid; we will fight everybody who comes in our way.

We are fighting silently, and loudly, and we will approach every forum, from our local corporator, MLA, MP Upto the Hon. Supreme Court. The voice of this 20 lakh strong Speakasian family will surely be heard.

Good Evening Speakasians,
After many days, a day, full of GOOD NEWS. After many days we had multiple successes and I take immense pride in reporting as follows.
 

GOOD NEWS #1: Mr. Rahul Shah the poor victim of the high handedness of the Authorities and an example of subversion of facts was today released on bail, by the Quila Court. To quote the companies Counsel Adv. Ponda this was “A classical example of picking up a wrong man in a wrong case”.
The faith of 20 lakh panelists has once again been imposed in the legal system when the Hon. Magistrate Esplanade Court released, Mr. Rahul Shah, employee of M/s Tulsiyant Info, a company no way connected to SAOL, on bail. Details of the order are awaited; I will post the details ASAP.
 

GOOD NEWS #2: Mr. Tarak Bajpai our inspirational leader and beloved COO along with the other three officials, none of whom is a SAOL official, were granted unconditional Bail, by the Magistrate in the Thane Court on a surety of Rs. 25000/- only per head. This order was pronounced in court only around 6.00 pm and as such our COO and the three others will have to spend yet another uneasy night on the floors of Thane Jail.
My heart bleeds to see this man who has led the speakasian family to great heights, who has been the architect of change in the standard of living of lakhs of families, sleeping on the floors of Thane Jail, fighting for the panelists, and still smiling.
 

TRIVIA:
1. The Domain name of your Association website has been confirmed and hopefully the site should be operational within the next 7 to 10 days.

2. The initial proposal of the PR agency has been received and has been circulated amongst the committee members for their opinion and suggestions. We should be able to finalise this soon and the panelists should see the PR exercise taking shape soon. I will share with you the details as they keep getting firmed up.
3. The Association has mooted the idea of setting up a call centre for better verbal communication with the large panelist family.

RUMOURS & UNSUBSTANTIATED REPORTS:
Without going into the details of the forum or the website where the stories were germinated, I attempt to clarify on “HOT” news items of the day.

SAOL has started paying their employees: A false statement to the core, without starting payment of the panelist the company will not pay the employees. All the employees are willing to stand by the company along with their leader Shri. Tarak Bajpai. The company is duty bound to first pay the Panelists followed by the vendors and finally the employees.
The State Government is going to go in appeal against the order of Mr. Tarak Bajpai and others bail order: This is a normal action in the legal process. An aggrieved party will always appeal to the next available medium available to them. So this does not come as a surprise to me as this is the established route available to the authorities.
Zee news report on Mr. Moilly referring the matter of SAOL to SFIO:
I have not seen this news item and as such cannot substantiate the same.
Allow me to comment on this tomorrow, I would like to study this in detail.

As is evident from the above we are moving in the right direction. Things are happening in our favour. On such a large scale, with Govt. Authorities involved we cannot decide the speed, but we can smell victory.

Some important Queries and their Answers : For Your Information .

At this point of time its a very good thing that we the 20 Lakh panelists of Speak Asia have formed an association named "Speak Asia Panelists Association" which is representing our case in judiciary, government and various concerned institutions. Please go through the following updates from the Secretary of our association:

When Will the Payouts Start?

This is a million dollar question and I am sure almost all the panelists including me are eagerly waiting for the payments to restart. I wish to draw your attention to the fact that the company has been approaching the RBI on various occasions but the pleas have fallen on deaf ears and the required permissions have not come through. Our Global CEO Ms. Haren Kaur has written to RBI once again on 19th August, 2011 and we again await some positive response.

I wish to draw your attention to The PIL filed by your Association before the Hon. High Court at Mumbai wherein one of the main prayers is that the RBI be instructed to withdraw the circular issued by them to all banks cautioning the banks against speakasia. It is also prayed that the company be allowed to pay out over 200000 Speak Asians whose requests are pending for payment.

In summation I wish to submit that come Wednesday 24th August, 2011 this question will be better answered once the Hon. High Court has heard the PIL.

When will the Surveys restart?

We are all aware that the servers of the company are being investigated by the EOW. This is the reason why the portal is not fully operational.

As soon as the EOW finishes the investigation they will hand over the portal back to SAOL and the surveys and the EXIT option will be activated.

The PIL of your Association pleads before the Hon. High Court to fix a time frame for the authorities to complete investigations of the company.

Once again this question will be clarified after the hearing of the PIL.

When will the PE be established?

This question will also be answered after the hearing of the PIL filed by your Association on Wednesday i.e. the 24th August, 2011.

Where is our CEO Mr. Manoj Kumar and our Global CEO Ms. Haren Kaur?

Friends both of them are safe and sound and monitoring the entire defence operation in all probabilities. I am sure they have not returned to India on the advice of their Legal counsel.

We should be hearing from them soon. May be they are waiting for things to get clarified in the
matter of Tarak Sahibs detention matter.

Why is our COO Mr. Tarak Bajpai being arrested again and again?

Mr. Tarak Bajpai was first arrested on 29th July, 2011 under the FIR resulting out of the order passed by the Hon. High Court in the criminal PIL filed sometime in July 2011. After serving the mandatory 14 days remand Mr. Bajpai was finally released on Bail Yesterday i.e. 20th August, 2011.

Once Mr. Tarak Bajpai was a free man he was once again arrested in yet another FIR filed at Mira
Road by the EOW Bhayander.

To counter this menace of multiple complaints in, if at all, one crime against SAOL the company management is in a huddle with their legal team.

On enquiries, SAOL have assured us that they will soon find a remedy to this, and put a stop to this menace which is becoming a huge irritant in the way of getting final release of our COO Mr. Tarak Bajpai.
Friends, fellow Speakasians we have to understand the gravity of the situation and assess the situation that we are currently in REALISTICALLY.

The matter is in the hands of various Govt. Agencies and they will work at their own speed, maybe purposely at a snail’s speed. This is why we introduced the PIL to speeden them up.

We have no choice but to be UNITED & PATIENT. This is the ONLY way we will WIN.

On a positive note I would like to inform you that Mrs. Renu Sharma wife of our CEO Mr. Manoj Kumar Sharma, was released from detention without being arrested, yesterday itself, because they could not find any reason or case against her,

which in itself is a huge testimony to the fact that the EOW has not got any substantial material against SAOL.

Following are the questions which we are getting from panelists all across the country which we would like to answer:


Q 1. When the Surveys will restart ?

Ans: The speakasiaonline.com website is still under control of Mumbai EOW. On Wednesday (17/08/2011) there is high level meeting of Company officials in Mumbai. On the same day the Company is going to ask EOW to hand over the access of the website back to SAOL. After that the surveys will start loading very soon. 


Q 2. When will payout/EXIT option start ?

Ans: On Wednesday (17/08/2011) the Company is going to ask EOW to hand over the access to panelist's database to SAOL and allow it to put exit option on site. If they allow, SAOL will send test payments. This test payments will be sent from Singapore through TT and if the banks in India allow the payments to be credited in Indian bank accounts of panelists (which depends on RBI allowing it), it will start payouts. 

Q 3. Where is the CEO and other top Management Officials of SAOL ? Why they are not giving public appearance ?

Ans: At this point of time the real battle is being fought in the court of law. SAOL has hired one of the best legal firm of India which is obvious from victory after victory at legal front. As of now the COO of the Company is leading the battle from front along with other warriors of the contingent. Whenever there will a point where the presence of the CEO and other top officials will be mandatory, they will be their without fail and answer any question.


Q 4. When the registration of the Company in India will be done and when the normal operations of SAOL will start ?

Ans: As BizBasket team has written in earlier articles in detail, registration of the Company is an event dependent on the approval of RBI as per section 591 of the Companies Act 1956. SAOL has already sent the business model in writing as required by the RBI after the Honorable Mumbai High Court judgement in favor of SAOL. Now the decision is pending with the RBI. As soon as it gives the clearance the registration process will be completed very soon. Once the registration is over the normal day to day business of the Company will start automatically.

MEGA updates to share with everyone - Some GREAT News..!!

The speakasia panelist forum organised rally had a turn out of about 7000 people at Azad Maidan VT Mumbai.

Various panelists took the mike and aired their views in support of SAOL.

In the evening the office bearers of the Association were taken to Mantralaya to submit their memorandum and charter of demands to the Home Minister Mr R. R. Patil.

The Ministers were not availabe to meet the association office bearers but their secretaries met them and heard their submissons and have assured them to look into the matter.

The rally/dharna had a festive feel about it and many recordings were shown on the LCD tV throughout the day.

The mood was lifted in the early evening after the good news from the quila court came in.

I, Ashok Bahirwani went up on the dias after the court hearings and summarised the events in the court before the gathering as follows:-

That the bail application was not heard today by the court as the SAY of the public prosecutor will be available on 16th August, 2011 so the bail application will now be heard on 16th August.

That Mr. Tarak Bajpai and 4 others were now sent to JC (Judicial Custody).

The Income Tax Department made an application for Taraks Custody but our council Mr. Abhat Ponda vehemently opposed this and said that there is no provision under law for IT dept to get custody of the accused, he said the IT dept can come and investigate Mr. Tarak while he is in JC.

A new FIR was filed by the Thane Police on a complaint of a panelist for Rs 1,00,000/- in Mira road police station and the Thane police were seeking a 14 day remand. Once again on strong arguments put up by the council of SAOL the court rejected the FIR and additional custody was denied.

In the Matter of the arrest of Mr.Rahul Shah Vp of Tulsiant Info the same Mr Ponda took the prosecutors to the laundry and bombarded the Mumbai police and also threatened them with filing a writ petition for defamation.

His case was that they have arrested a wrong person in a wrong case. He further went on to explain that Tulsianttech is a company which had dealings with SAOL but Tulsiantinfo had no dealings with SAOL. He further submitted before the court that Tulsiantinfo was a company which is a registered company and had licence to import LCD/LED Tvs. He wanted to know from the police and the prosecution what record they had to prove that Tulsianttech and Tulsiantinfo were the same company as they were trying to prove. As the Prosecution could not prove the Court sent the accused to only 3 days of PCR (Police custody remand) and the bail applictaion will be also heard on 16th.

Today the 12th August in the holy month of Shravan and Ramzan is a milestone day in the road to sucess of all speakasians.

Today is the day which will be seen as the halt of the downslide of doubt for all speakasiands. From 16th August hopefully, inshallah, hari icha the upward trend will again start and now sky is the limit and 16th August will mark the of our march to number one position for speakasians and indeed for SAOL.Speak Asia Moving Step By Step Legally.Clean Chit Expected soon from all Agencies.

The Mumbai Judicial Hearing of 12th August

The court has rejected the extension of date of custoday of all 6 officials of speakasia including Mr. Tarak Bajpayee, so now on 16th August due to holidays in between.  Next hearing will be going on regarding bail and all the obligations has been rejected!

Mr. Tarak Bajpei and other 5 custodians are shifted from Police custody to Judicial custody,
because, today trial took place, and also EOW submitted its final report, now trial took place today in court, and the Jurisdiction will now go through the report submitted, and then final verdict of court will come.
Hope this progress is in right way to our success.
One more thing, today the real final report of EOW would have been sent to RBI.
